BetOnSports Founder Kaplan Seeks DOJ Dismissal
from the Bookmaker's Review, Kaplan is vehemently opposed to the Department of Justice's (DoJ) charges against him and is demanding to be released.
BetOnSports was forced to withdraw from the US market, it's primary source of income, under pressure from the DoJ, essentially driving the business into the ground. The DoJ has filed charges against Kaplan regarding violation of the Wire Act and Racketeer Influenced and Corrupt Organizations
Act (RICO).
Kaplan has employed a team of legal eagles to assist in his efforts of convincing the DoJ to dismiss the charges and release him from incarceration. The team of expert lawyers includes Ben Brafman, who has represented rapper P Diddy and Jay Cohen, a former online gambling entrepreneur.
According to reports, the legal team has applied for Kaplan's release, with the dismissal of all charges, stating the DoJ's interpretation of the Wire Act of 1961 is "overly broad" and that the case does not fall under the guidelines of the RICO Act. The application claimed that in order to qualify for violation of RICO, two factors must be present; "the continuity and structure necessary for a RICO enterprise and a pattern of racketeering activity."
It has been said that Kaplan is not a well man, and that his incarceration has only proved to intensify his illness. Reports also state that Kaplan suffers severe back pain due to a past injury.
A source close to Kaplan revealed, "[Kaplan] is currently being denied medication and a diet suitable for the conditions ....and he's in a 30 person facility with no special units."
