Two Country
This week Germany has been in the news with their view of online gambling and it seems Germany and their Administrative Court of Appeals have the opposite thoughts on it than France.
In Court this week a German Administrative Court of Appeals in Hessen reviewed the case brought before them from a lower court. The case was one that barred Bwin the company that is licensed in Gibraltar and that operates PokerRoom from opening a German online site.
This Administrative Court of Appeal had a ruling that differed in the fact that they see the impossibility of enforcing a ban for online gambling according to Thompson Financial so in this frame of thought the lower court ruling was overturned. To agree with the lower court decision it was felt would be senseless, as online gambling cannot be kept out of the country.
This in effect could open trade with the European Union, as this is the outcome they had been working toward with not only Germany but France also.
France has been rather difficult in negotiations with the European Union and the outcome from their negotiations will not be known until possibly as late as March of 2008.
