Full Tilt Poker Files Motion of Dismissal in Clonie Gowen Case
Clonie Gowen is still tangled up with Full Tilt Poker in a legal battle that has been going on for the last few months. Gowen filed the suit against Full Tilt and its Team members citing several items including Breach of Contract and Unjust Enrichment. The most recent move was on Full Tilt’s part. They have recently filed a twelve page motion to dismiss the court case.
The motion was filed to answer Clonie’s suit where she wanted $40 million in compensation and damages after she was dropped by the website. The motion for dismissal was filed by the lawyers of Full Tilt, Olson, Cannon, Gormley and Desruisseaux of Las Vegas.
In the filing Full Tilt has asked for Clonie to refine her claims and re-file the case or the individual players that were named in the case should be dropped from the action suit. An excerpt from the motion stated: “Ms. Gowen may, or may not, be able to make a claim for breach of an oral contract, but she certainly does not have a shotgun claim for fraud against her thirteen fellow poker pros, or a ‘minority oppression,’ or breach of fiduciary duty claim against the individual defendants.”
It will be interesting to see now what Clonie will decide to do and where this case will lead to. It has definitely been an interesting story of 2008 and now has moved on to the New Year.
